Congressional Notification

The U.S. Congress must approve your sale to a foreign party prior to authorization being granted. This may add six months to a year to your approval schedule as Congress only reviews applications when they are in session and only on certain days of the month. Again, your compliance professional will know when a project requires Congressional Notification and when it does not.

Congressional Notification will always be required for the production (manufacture) overseas of SME or the sale of Major Defense Equipment (MDE) valued at $25 million for NATO, Australia, New Zealand, South Korea, or Japan or $100 million for the sale of Defense Articles or defense services to NATO Australia, New Zealand, or Japan.

For all other countries the value drops to $50 million.
