The consequences of non-compliance with the regulations for imports and exports can be incredibly costly and ultimately involve the loss of a right to export, very high fines, negative publicity for your organization, and jail time. TigerSwan takes its responsibility to comply with these regulations very seriously. Employees and ICs who willfully violate these regulations will be subject to disciplinary action up to and including termination. Should an employee or IC engage in an activity that is truly a major violation of the laws and has damaged national security in some way, TigerSwan can report that individual to the U.S. Government and cooperate in their prosecution.
Remember from the beginning of this training, the purpose of Export and Import controls are to protect our country's National Security and competitive edge in business and in armed conflict. When an organization chooses not to follow the rules and regulations they may want to consider that they are somewhat culpable when the U.S. War Fighter is killed because someone failed to follow the regulations and allowed the wrong equipment, technical information or training to get into the wrong hands. Be cognizant of your role in protecting those individuals that are on the front lines protecting our country's freedoms and values. Do not assume your training here has given you enough knowledge to make complex decisions related to the way Export and Import controls are implemented. You should always rely on your compliance professional. Your responsibility is to stop and think about the actions you are taking and then obtain guidance on those actions prior to acting. In addition you should understand your authorizations and limitations, understand the scope of your program and know the level of controls on all equipment and materials related to your program. You should have a clear understanding of the records you are required to keep and what you may and may not discuss with a foreign party. It is your responsibility to make sure you ask questions and comply with the law — be sure to consult your export expert frequently.
