Prior approval is required by the Department of State if your activity meets all of these parameters:
- The item or service is SME and worth more than $14 million dollars
- The item will be used by the armed forces of countries other than NATO, Australia, Japan, South Korea and New Zealand; and the activity is related to the export of a Defense Article or defense service; and the identical (not similar) item or service has never been previously exported or approved for foreign sale — for instance — if your organization wished to sell a new Unmanned Aerial Vehicle (UAV) that was $15 million dollars, to Mexico and it was a brand new item, never sold anywhere in the world and classified as SME — you would have to get prior approval from the Department of State prior to making a proposal to Mexico for the sale.
