Controlled EAR Technology

 Controlled technology is technical data or technical assistance that is necessary for the development, production, or use of a product.

Controlled "technology" is defined in the General Technology Note and the Commerce Control List within the EAR. This may include software on your computers and instructions on how to operate certain equipment. Even items that may seem easily accessible to anyone worldwide such as the manual for an armored vehicle may be controlled. Do not be fooled by thinking that because you are able to purchase something on the open market that the item is not controlled or does not require some authorization to share it with a Foreign Person. Often software is controlled both by foreign countries and by the U.S. For example, encryption software can be highly sensitive — even open market software and is not allowed entry into some Soviet Block nations. If you need software for your computer — or wish to download software while you are overseas, you must contact your export compliance Point of Contact (POC) prior to the purchase or download to make sure there are no violations of export and import regulations.
